Unlike express consent, implied consent expires for Canadian contacts who are subject to CASL regulations.

Auto-expiry of implied consent

Implied consent based on an inquiry automatically expires six months after last obtained.

Implied consent based on a transaction automatically expires two years after last obtained.

Expiry only applies to Canadian contacts. 

Examples

Here are a few examples to better understand the distinction between Canadian, non-Canadian and "unknown/blank" location contacts when there is no express consent:

If express consent is not provided after a contact fills out a form and:

  • the contact indicates on the form that they are Canadian they will be assigned "Implied consent based on inquiry". This consent status expires automatically six months after the form submission.
  • the contact indicates on the form that they are not Canadian they will be assigned "Implied consent - no expiry". This consent status never expires.
  • the contact does not indicate their location (country = unknown) then the default country field will be applied. Based on that the contact will be assigned "Implied consent based on inquiry" or "Implied consent - no expiry" status.
